Legal Agreement

Terms of Service

These Terms govern your use of Constant Funded’s trader evaluation services, simulated trading accounts, dashboard, payments, and performance rewards. Please read them carefully. They limit our liability and require disputes to be resolved individually through arbitration.

Last updated: October 1, 2026Simulated Trader Evaluation

The key points

  • We sell evaluation services. We are not a broker, investment firm, or fund, and we never invest your money.
  • Every account, including a Funded Account, is simulated. You never trade on a real market and never trade real capital.
  • Payouts are performance rewards we pay when you follow the rules. They are not guaranteed, not wages, and not investment returns.
  • Breaking a rule can end your account and cancel unpaid rewards, and fees are not refunded.
  • One account per person. Duplicate accounts and misusing coupons, rewards, or promotions lead to a permanent ban.
  • We may suspend or end any account or service at any time, as these Terms describe.
  • Disputes are resolved individually through binding arbitration. Class actions and jury trials are waived.

This summary is for convenience only. The full Terms below are what bind you and us.

1. Agreement to These Terms

These Terms of Service (the “Terms”) are a binding legal agreement between you and Constant Funded (“Constant Funded”, “we”, “us”, or “our”). They govern your access to and use of our website, trader dashboard, evaluation programs, simulated trading accounts, trading credentials, payment flows, certificates, rewards, payout request systems, support channels, community channels, and every related product, feature, or service (together, the “Services”).

By creating an account, ticking an acceptance box, purchasing or receiving any program, logging in to a trading account, or requesting a payout, you confirm that you have read, understood, and agreed to these Terms, our Program Rules, our Risk Disclosure, our Privacy Policy, and our KYC Disclaimer, each of which forms part of this agreement. If you do not agree, you must not use the Services.

The Program Rules published on our website and in your dashboard are incorporated into these Terms. If the Program Rules and these Terms conflict on a trading matter, the Program Rules apply. On every other matter these Terms apply.

2. What We Provide: Evaluation Services Only

Constant Funded provides trader evaluation services. We assess a trader’s skill and discipline in a simulated environment and, where a trader meets our rules, we may pay a performance reward. That is the whole of our service.

Constant Funded is not, and does not act as:

  • a broker, dealer, futures commission merchant, or introducing broker;
  • an investment adviser, investment manager, asset manager, or fund;
  • an exchange, trading venue, or market maker for you;
  • a bank, custodian, payment institution, or deposit-taking institution;
  • an employer, partner, agent, or fiduciary of any user.

We do not provide investment, financial, trading, tax, or legal advice, and we do not recommend or solicit the purchase or sale of any financial instrument. Dashboards, analytics, educational material, market data, statistics, and any other content are provided for information and evaluation purposes only.

3. Simulated Accounts: You Never Trade Real Markets

Every account we provide is a simulated (demo) account that uses virtual funds with no cash value. No trade you place is executed on a live market, routed to a real exchange or liquidity provider on your behalf, or backed by real capital belonging to you or to us. This applies to Evaluation Accounts and Funded Accounts alike.

Simulated prices, spreads, fills, slippage, swaps, commissions, liquidity, and execution speed may differ from real market conditions, and we do not promise to reproduce them. We do not offer real market conditions. A result achieved in our simulated environment does not mean the same result could be achieved on a live market.

Virtual balances, equity, and “account sizes” are evaluation parameters, not money. They are not a deposit, loan, credit line, allocation of capital, securities account, or managed account. You have no ownership, claim, or right to withdraw any virtual balance or simulated profit.

Constant Funded may, at its sole discretion and for its own account, use trading data generated on the Services for any lawful purpose, including risk management, research, and analysis. Any such activity is ours alone. It does not make you a participant in any real trading, and you have no claim to its results.

4. Evaluation Accounts and Funded Accounts

We offer two kinds of simulated account. Both are part of the same evaluation service.

Evaluation Account. The account you receive when you buy a program. You trade it in a simulated environment to meet the profit target and other objectives of your program while staying within every Program Rule. Evaluation Accounts are not eligible for payouts. Passing an evaluation does not entitle you to anything except, at our discretion, the offer of a Funded Account.

Funded Account. A simulated account we may offer after you pass an evaluation and complete verification. Despite its name, a Funded Account is not funded with real money and does not trade on a real market. It continues the evaluation of your trading under the same or stricter rules. Your simulated results on a Funded Account are the measure we use to calculate any performance reward we may pay you.

The key differences: Evaluation Accounts test whether you can meet the program objectives and never pay rewards. Funded Accounts can make you eligible for performance rewards, subject to these Terms and the Program Rules. Neither kind of account is a real trading account, and neither gives you any right to real capital.

We may decline to offer a Funded Account, or set additional conditions before offering one, including identity verification, a trading review, and acceptance of a separate Funded Trader agreement.

5. Eligibility

You may use the Services only if, at all times:

  • you are at least 18 years old and have full legal capacity to enter into these Terms;
  • the information you give us is true, accurate, complete, and your own;
  • you are not located in, resident of, or operating from a restricted jurisdiction;
  • you are not subject to sanctions or any restriction that prohibits your use of the Services;
  • your use of the Services is lawful where you live.

You are responsible for knowing and complying with the laws that apply to you. We may refuse, restrict, or end access where we cannot confirm eligibility.

6. Your Account and Security

You may hold only the accounts the Program Rules allow, and only in your own name. You must keep your login details, trading credentials, devices, email, and payout wallet secure, and you are responsible for everything done through your account.

You must not sell, rent, share, transfer, or let anyone else access, trade, or manage your account, including through account management or passing services. Tell us immediately if you suspect unauthorized access.

One account per person. Each person may register and use only one Constant Funded user account. You must not create or use duplicate accounts, whether under different email addresses, names, devices, or payment details, or by opening or running accounts for or through other people. Duplicate accounts are prohibited even where each one is used for a separate purchase.

We may treat accounts as linked to the same person using email, identity, billing, payment, device, IP, referral, and reward-redemption information, and any other evidence available to us. If we find duplicate or linked accounts used in breach of these Terms, we may permanently ban the person and close every linked account, including any Evaluation Account or Funded Account held through them, and cancel any pending reward, points, payout, or commission, without a refund.

7. Program Rules and Trading Objectives

Every program has its own Program Rules, which may include profit targets, daily and maximum loss limits, minimum and maximum trading days, consistency requirements, position and exposure limits, news and weekend restrictions, permitted instruments, and prohibited strategies.

You are solely responsible for reading, understanding, and following the Program Rules that apply to your account. Not knowing a rule is not a defense. We may update the Program Rules from time to time. Updates apply to accounts purchased after the update and, where needed to protect the integrity of the Services or comply with law, to existing accounts after notice in your dashboard or by email.

8. Prohibited Trading Practices

Because our accounts are simulated, some strategies can produce results that could never be achieved on a real market. These, and any other practice we reasonably consider abusive, are prohibited, including:

  • latency arbitrage, quote or price-feed exploitation, or exploiting platform errors;
  • hedging or opposing positions across accounts, users, or firms (including reverse or group hedging);
  • tick scalping, high-frequency trading, or order flooding that abuses the simulated environment;
  • copy trading, signal services, or trading another person’s strategy where the rules forbid it;
  • coordinated trading with other users to share or spread risk;
  • using multiple accounts or identities to get around any limit;
  • gambling-style trading, such as all-or-nothing positions sized to hit a target in one trade;
  • any strategy that could not reasonably be repeated under real market conditions;
  • automated tools, bots, or expert advisors not permitted by the Program Rules;
  • tampering with, spoofing, or falsifying trading data, device data, or records.

Whether a practice is prohibited is decided by Constant Funded in its sole discretion, acting in good faith.

9. Reviews, Breaches, and Final Decisions

We may review any account at any time, including before approving a Funded Account or a payout. Reviews may use trading records, server logs, rule-engine results, device, IP and identity data, payment records, and any other evidence available to us.

If we find a breach of the Program Rules or these Terms, we may fail the account, close it, reset it, cancel or reduce any pending reward, or take any other action described in these Terms. An account that breaches a hard rule (such as a loss limit) fails automatically when the breach occurs.

Our determinations on account status, rule breaches, prohibited practices, and payout eligibility are final and binding, subject only to applicable law. Our records, including backend, trading-server, and audit records, are conclusive evidence of what happened on an account unless clearly shown to be wrong.

10. Performance Rewards (Payouts)

A payout is a discretionary performance reward that Constant Funded may pay when a trader with a Funded Account meets every applicable Program Rule. It is calculated by reference to simulated results. It is not a share of real trading profits, a return on any investment, interest, a wage, or a salary, and it is not guaranteed.

A payout becomes payable only when all of the following are true:

  • you have a Funded Account in good standing;
  • you have followed every Program Rule and these Terms for the entire period the payout covers;
  • you have passed identity verification and any trading or compliance review we require;
  • you have met the payout cycle, minimum amount, and other payout conditions;
  • we have approved the payout request.

We may delay, reduce, deny, or cancel a payout, and may close the related account, if we find or reasonably suspect a rule breach, prohibited practice, false information, duplicate account, payment dispute, sanctions concern, or other integrity issue. Rewards that have not been paid are forfeited when an account is closed for a breach.

Any payout made in error, or later found to result from a breach, fraud, prohibited practice, payment reversal, or inaccurate data, must be repaid on request, and we may set it off against any amount we owe you.

You are responsible for giving us correct payout details. We are not responsible for losses caused by wrong wallet addresses or networks, third-party providers, or blockchain delays.

11. Fees, Payments, and No Refunds

Program fees are fees for our evaluation service. They are not deposits, investments, or trading capital, they are not held for you, and they earn no interest or return. Prices and offers may change at any time before purchase.

A program is activated only after we confirm your payment through our systems. Screenshots, wallet broadcasts, or other user-supplied proof do not activate a program. We may cancel or correct any order affected by a pricing error, payment mismatch, suspected fraud, or technical mistake.

All fees are final and non-refundable once your account or trading credentials have been issued, including where your account is failed, breached, closed, or terminated, unless these Terms say otherwise or applicable law requires a refund. Discounted, free, promotional, and reward-redeemed programs are never refundable.

12. Chargebacks, Coupons, Promotions, and Payment Abuse

You must not file a chargeback or payment dispute for a service you received. If a payment is disputed, reversed, or flagged as fraud, we may immediately suspend or close every account linked to you, cancel any pending reward, refuse future purchases, and recover our costs and losses to the extent the law allows.

Coupons, discount codes, reward codes, and promotional offers (together, “Promotions”) are subject to these rules unless we state otherwise in writing:

  • a Promotion is valid only for the person it was issued to and only for the plan, account size, and number of accounts it was issued for;
  • a Promotion cannot be combined with a bundle discount or any other offer, and only one Promotion may be used per order;
  • a Promotion has no cash value and must not be sold, shared, transferred, traded, or published;
  • reward codes may be used only by the trader who earned them;
  • we may change, limit, or withdraw any Promotion at any time.

You must not misuse or exploit our checkout, pricing, coupon, reward, or referral systems, including by using a Promotion outside its terms, by exploiting an error, bug, or loophole to obtain an account for free or for less than its intended price, or by using another account to redeem, refer, or benefit yourself. If you find such an error, you must report it to us and not use it.

If we find or reasonably suspect misuse of a Promotion or of these systems, we may, without notice, cancel the Promotion and any affected order, close every account obtained through the misuse or linked to you, permanently ban you from the Services, forfeit any reward, points, payout, or affiliate commission, and recover the full price of anything obtained, to the extent the law allows. No refund is owed in these cases.

13. Suspension and Termination

We may suspend, restrict, or terminate your account, any program, or your access to any part of the Services at any time, with or without notice, if we believe that you have breached these Terms or the Program Rules, used a prohibited practice, given false information, failed verification, abused payments, misused a Promotion, operated duplicate accounts, behaved abusively toward staff or users, or created legal, regulatory, payment, fraud, or reputational risk for us. In those cases you are not entitled to a refund, to any unpaid reward, or to any compensation.

We may also stop offering any program or end any account for business reasons that have nothing to do with your conduct. If we do that, our only obligations are, at our choice, to refund the fee for an Evaluation Account you have not yet failed or passed, or to pay any reward you had already fully qualified for under Section 10 before termination. You agree that this is your sole remedy.

You may stop using the Services at any time. Termination for any reason does not entitle you to compensation for lost opportunity, lost rewards, or lost profits, and Constant Funded is not liable to you or anyone else for terminating an account or service in line with these Terms.

14. Identity Verification and Compliance

We may require identity, address, payment, wallet, device, or video verification, and tax information, before offering a Funded Account, approving a payout, or continuing the Services. Failing to complete verification, or giving false or borrowed information, may lead to payout denial and account closure.

15. Restricted Jurisdictions and Sanctions

We do not offer the Services in restricted jurisdictions, which include countries subject to FATF, EU, UN, or other applicable sanctions and the countries listed in our Risk Disclosure. You must not use VPNs, proxies, false addresses, or another person’s identity to get around any restriction.

16. Taxes

You are solely responsible for any taxes on amounts you receive from us. We do not give tax advice and may request tax information where the law or our payment providers require it.

17. No Guarantee of Results and Assumption of Risk

We do not guarantee that you will pass an evaluation, receive a Funded Account, earn a reward, or achieve any financial result. Most participants do not pass. Testimonials, payout posts, statistics, and marketing are not promises of any outcome.

You take part voluntarily and at your own risk, and you accept that you may lose the full amount of any fee you pay.

18. Platform Availability and Errors

We do not guarantee that the Services, trading platforms, data feeds, or payment systems will be uninterrupted, error-free, or always available. We are not liable for failed evaluations, missed trades, delays, or losses caused by outages, maintenance, third-party providers, cyberattacks, or events outside our reasonable control.

We may correct any error, including pricing errors, incorrect account status, calculation errors, duplicate accounts, and incorrect payouts. Where our dashboard and our backend records disagree, our backend records apply.

19. Third-Party Services

The Services rely on third parties such as trading platforms, data providers, payment processors, verification providers, and cloud hosts. We are not responsible for their acts, failures, fees, or restrictions.

20. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation.

21. Limitation of Liability

To the maximum extent permitted by law, Constant Funded and its owners, directors, officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, rewards, opportunity, data, or goodwill, arising from or related to the Services, any failed or terminated account, any denied or reduced payout, or these Terms, however caused and even if we were told such damages were possible.

To the maximum extent permitted by law, our total liability for all claims relating to the Services or these Terms is limited to the fees you paid us for the specific program giving rise to the claim during the three months before the claim arose.

Nothing in these Terms limits liability that cannot be limited under applicable law.

22. Indemnity

You agree to indemnify and hold harmless Constant Funded and its owners, directors, officers, employees, contractors, and partners from any claims, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Services, your breach of these Terms or the Program Rules, your violation of any law, or any chargeback or fraud connected to your account.

23. Dispute Resolution, Arbitration, and Class Action Waiver

Contact us first. Before starting any claim, you must email support with your account email, a clear description of the issue, and the outcome you want, and give us 30 days to try to resolve it.

Binding individual arbitration. Any dispute, claim, or controversy arising from or relating to these Terms or the Services that is not resolved informally will be finally resolved by confidential, binding arbitration before a single arbitrator, conducted in English and held remotely by video conference or on written submissions, under the rules of a recognized international arbitration institution chosen by Constant Funded. The arbitrator’s award is final and may be entered in any court with jurisdiction. Either party may bring an individual claim in a small-claims court instead, and either party may seek an injunction to protect its intellectual property.

No class actions or jury trials. You and Constant Funded each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. You and Constant Funded each waive any right to a jury trial.

Time limit. Any claim must be brought within one year after it arose, or it is permanently barred, unless applicable law requires a longer period.

Governing law. These Terms are governed by the laws of the jurisdiction in which Constant Funded is organized, without regard to conflict-of-law rules. If any part of this section is found unenforceable, the rest continues to apply, except that if the class action waiver is found unenforceable for a claim, that claim may proceed only in court and not in arbitration.

24. User Conduct

You must not:

  • hack, attack, overload, scrape, reverse engineer, or disrupt the Services;
  • bypass authentication, rate limits, or other security controls;
  • submit false documents, edited screenshots, or fake payment proof;
  • harass, threaten, impersonate, or abuse staff, users, or partners;
  • resell or commercially exploit accounts or the Services without written approval;
  • use the Services for any unlawful, fraudulent, or deceptive purpose.

25. Intellectual Property

Constant Funded owns or licenses all rights in the Services, including our brand, software, content, designs, data, and certificates. You may not copy, sell, clone, scrape, or build a competing service from any part of them without our written permission.

26. Communications

We may contact you by email, dashboard notice, or any channel linked to your account, and notices are effective when sent. Keep your contact details accurate and check them regularly.

27. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted, unless a later date is stated. Continuing to use the Services after a change means you accept it. If you do not agree, you must stop using the Services.

28. General

These Terms, together with the documents they incorporate, are the entire agreement between you and Constant Funded about the Services. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest of the Terms remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to any affiliate or successor. Sections covering fees, payouts, termination, liability, indemnity, and dispute resolution survive the end of your account. The English version of these Terms prevails over any translation.
